Terms of Service

These Terms of Service (the "Terms") are a binding agreement between you and Casa Bella ("Casa Bella," "we," "us," or "our"). By creating an account or using Casa Bella, you agree to these Terms.

You must be at least 18 years old to use Casa Bella. If you accept these Terms on behalf of an agency, company, or other organization, you represent that you have authority to bind that organization, and "you" includes that organization.

Casa Bella is a subscription service for models and micro-influencers that automates PR outreach. On your behalf, it gathers contact and profile data for brand-side people from third-party sources, scores leads with AI, drafts personalized outreach emails in your voice, sends and follows up on those emails from your connected mailbox, polls your inbox for replies, and helps you manage leads. Deal types the product can facilitate include gifting, affiliate, paid partnership, ambassador, UGC, casting/editorial, and events/press.

You are responsible for your account credentials and for all activity under your account. Keep your login details secure. Tell us promptly if you believe your account has been compromised.

Emails sent through Casa Bella are sent from your own email account and email address. You are the sender of record for every message.

You are solely responsible for every email sent through your connected account, including its content, its recipients, and its compliance with applicable law. Casa Bella drafts and schedules messages at your direction; you remain the sender.

You warrant that your use of Casa Bella complies with the U.S. CAN-SPAM Act and, where applicable, GDPR/PECR, Canada's CASL, and other anti-spam and marketing laws. That includes: no misleading headers or subject lines; including a valid physical postal address in commercial messages where required; honoring opt-outs promptly; and ceasing contact with anyone who asks you to stop.

You must review AI-generated drafts before they are sent. You are responsible for their accuracy. AI drafts may contain errors. Casa Bella does not guarantee the accuracy of generated content.

Casa Bella may enforce sending caps, warmup schedules, and volume limits. We may pause or block sending at our discretion to protect deliverability and prevent abuse.

By connecting a mailbox (Google OAuth, Microsoft OAuth, or IMAP/SMTP credentials), you authorize Casa Bella to send email on your behalf from that account, to read replies to outreach threads for the purpose of managing leads, and to store your credentials and tokens encrypted.

You may not use Casa Bella to:

• Send spam or bulk unsolicited email outside the product's intended one-to-one outreach. • Harass anyone. • Deceptively impersonate another person or brand. • Send to purchased or imported lists obtained outside the service's intended lead discovery flow. • Transmit illegal content. • Attempt to evade rate limits or sending caps. • Resell or share your account. • Scrape, reverse-engineer, or otherwise attack the Casa Bella service itself. • Contact minors. • Violate any contract you are bound by. If you are signed to exclusive agency or management representation, you are responsible for ensuring that direct outreach through Casa Bella does not breach your representation agreement.

Lead data is gathered from public sources and third-party providers (including Apify actors that collect data from LinkedIn, Instagram, TikTok, X, and website scrapes). Lead data is provided "as is." We do not guarantee its accuracy or completeness. Email addresses may be verified through third-party services such as Bouncer; verification does not guarantee deliverability or consent to contact.

Casa Bella is not affiliated with or endorsed by LinkedIn, Instagram, TikTok, X, Google, Microsoft, or any brand you contact. Your use of connected Google or Microsoft accounts is also governed by those providers' terms.

Any contact, negotiation, or deal between you and a brand is solely between those parties. Casa Bella is not a party to, agent for, or guarantor of any deal, partnership, gift, or payment.

Casa Bella is a paid subscription. A payment method is collected when your free trial starts. Payments are processed by Stripe.

Your free trial converts to a paid subscription of $39/month automatically at the end of the trial period unless you cancel before the trial ends. We will charge the payment method on file.

After the trial, your subscription renews automatically each month at $39/month until you cancel. Cancellation takes effect at the end of the then-current billing period. You can cancel in-app under Settings, or by contacting support at hello@getcasabella.com. We do not provide refunds for partial billing periods except where required by law.

We may change prices with at least 30 days' notice by email or in-app notice. Taxes may apply and will be charged where required.

By starting a trial or paid subscription, you acknowledge the renewal terms, charge amount, and cancellation method described above.

Casa Bella owns the service, software, branding, and related intellectual property. These Terms do not transfer ownership of our IP to you.

You own your content — including your profile information, uploaded assets, and your edits to drafts. You grant Casa Bella a limited, worldwide, non-exclusive license to host, process, transmit, and display your content solely as needed to operate and improve the service.

As between you and Casa Bella, you own your outgoing emails. Casa Bella claims no ownership over messages you send. AI-generated drafts become your content once you adopt, edit, or send them.

Content generation in Casa Bella uses third-party large language models (including via the Anthropic API). Output may be inaccurate, incomplete, or similar to output generated for other users. You are responsible for reviewing all AI-generated content before sending, as described in Section 3.

Either party may terminate these Terms. You may stop using the service and cancel your subscription as described in Section 6.

Casa Bella may suspend or terminate your account immediately for acceptable-use violations, deliverability risk, non-payment, legal risk, or other material breach. After account closure, we may delete your data subject to our Privacy Policy and any legal retention obligations. See /privacy for how we handle personal data.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASA BELLA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant results. We do not guarantee brand responses, deals, partnerships, gifts, press, or income. We do not warrant the accuracy of lead data or that emails will be delivered, opened, or answered.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASA BELLA'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE FEES YOU PAID TO CASA BELLA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

CASA BELLA WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow certain limitations. In those cases, the limitation applies to the fullest extent permitted by law.

You will indemnify, defend, and hold harmless Casa Bella and its officers, directors, employees, and agents from and against claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from: (a) emails sent through your connected account; (b) your violation of law, including anti-spam and marketing law; (c) your breach of any representation, agency, or management contract; and (d) your content.

These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law rules.

Any dispute arising out of or relating to these Terms or the service will be resolved by binding individual arbitration administered under the applicable rules of a recognized arbitration provider seated in Michigan, not in court, and not by jury trial. Either party may still seek injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property or confidential information.

You may opt out of arbitration within 30 days of first agreeing to these Terms by sending written notice to hello@getcasabella.com. If you opt out, disputes will be brought exclusively in state or federal courts located in Michigan, except where prohibited by law.

Class actions, class arbitrations, and representative actions are waived to the fullest extent permitted by law. You and Casa Bella may bring claims against each other only in an individual capacity.

We may update these Terms from time to time. For material changes, we will notify you by email or in-app notice. The updated Terms will show a new effective date. Continued use of Casa Bella after the effective date is acceptance of the updated Terms. If you do not agree, stop using the service and cancel your subscription.
